These terms govern your use of chasingfoil.com (“ChasingFoil”, “we”, “us”). By using the site you agree to them. If you don’t agree, please don’t use the site.

1. What ChasingFoil is (and isn’t)

ChasingFoil is a research and collecting tool for trading-card enthusiasts: price history, statistical price outlooks, graded-value data, and collection tracking. Nothing on this site is financial, investment, tax, or legal advice. Price outlooks are estimates from a statistical model in beta; they will sometimes be wrong. Trading cards are collectibles, not securities. Any decision to buy, sell, hold, or grade a card is yours alone, and you bear all risk of those decisions.

Assumption of risk. Collectible markets are volatile and illiquid. You acknowledge that ratings and outlooks can be wrong, that past movement does not predict future movement, and that you assume the entire risk of any purchase, sale, hold, or grading decision you make — whether or not it was informed by anything on ChasingFoil. We have no fiduciary, advisory, or brokerage relationship with you.

2. Accounts

You need an account for binders, alerts, and Pro features. Keep your credentials secure — you’re responsible for activity on your account. You must be at least 13 years old (or the minimum age of digital consent where you live) to create an account. We may suspend or terminate accounts that violate these terms or abuse the service.

3. Pro subscriptions & billing

• Payments are processed by Stripe; we never see or store your card number.
• Automatic renewal: paid subscriptions renew automatically at the then-current price for the same period (monthly or annual) until you cancel, and you authorize us to charge your payment method on that recurring basis. You can cancel anytime from your account’s billing portal; cancellation takes effect at the end of the current paid period, and access continues until then.
• Lifetime (founding) purchases are one-time payments for the life of the service. They are limited in number and non-transferable except as we expressly allow.
• Prices and plan features may change; changes won’t apply retroactively to time you’ve already paid for.

4. Acceptable use

You agree not to:

• scrape, harvest, or bulk-download site data, or resell or redistribute our data or forecasts;
• probe, disrupt, or overload the service, or attempt to access other users’ data;
• share Pro content or credentials outside your own account;
• use the service for anything unlawful.

5. Your content

Binders, notes, and other content you create remain yours. Your binders are private by default; if you generate a share link, anyone with that link can view that binder until you disable sharing. You grant us the limited license needed to store and display your content to you (and to others, only where you’ve shared it).

6. Data & availability disclaimer

Prices, graded values, and forecasts are aggregated from third-party marketplaces and statistical models, provided as is and as available. Data may be delayed, incomplete, or wrong; the service is in beta and may change or be interrupted at any time.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service or its data will be uninterrupted, error-free, or that any outlook will prove correct. Some jurisdictions don’t allow certain warranty exclusions, so parts of this may not apply to you.

7. Limitation of liability

To the maximum extent permitted by law, ChasingFoil and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, value, or data, arising from your use of the service — including decisions made in reliance on prices or forecasts. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

8. Intellectual property

The ChasingFoil name, site, design, software, and data compilations are our property. See the Copyright Notice for details, including Pokémon-related trademarks and our DMCA contact. ChasingFoil is not affiliated with, endorsed, or sponsored by Nintendo, Creatures Inc., GAME FREAK, or The Pokémon Company.

9. Indemnification

You agree to indemnify and hold harmless ChasingFoil and its operators from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of your use of the service, your content, your violation of these terms, or your violation of any law or any third party’s rights.

10. Disputes — informal resolution, arbitration & class-action waiver

Almost everything can be sorted out by email, so contact us first — you agree to try to resolve any dispute informally for at least 60 days before starting a formal proceeding.

If we can’t resolve it, you and ChasingFoil agree that any dispute arising out of or relating to these terms or the service will be settled by binding individual arbitration, not in court — except that either party may bring qualifying claims in small-claims court. You and ChasingFoil waive any right to a jury trial and agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.

You may opt out of this arbitration agreement by emailing hello@chasingfoil.com within 30 days of first accepting these terms; opting out won’t affect the rest of these terms. Where a jurisdiction limits or prohibits any part of this section, that part applies only to the extent permitted by law.

11. Affiliate disclosure

Some links to outside marketplaces (such as TCGplayer and eBay) are affiliate links: if you buy through them, we may earn a commission at no additional cost to you. This never changes the prices, data, or ratings we show — those are generated independently of any commercial relationship.

12. Changes, severability & governing law

We may update these terms as the service evolves; material changes will be reflected by the date above, and continued use means acceptance. If any provision is found unenforceable, the rest remain in full effect. These terms — together with our Privacy Policy, Cookie Notice, and Copyright Notice — are the entire agreement between you and ChasingFoil regarding the service. They are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules; subject to Section 10, the exclusive venue for any permitted court action is the state or federal courts located in Texas.
